Terms of Service for Manga Creator

1. Introduction

Welcome to Manga Creator, owned and operated by Kawaii, Inc., an AI-powered image & text generation application. These Terms of Service ("ToS") are a legal contract between you, the user, and Manga Creator ("we", "us", or "our"), governing your use of the Manga Creator application and services.

2. Acceptance of Terms

By creating an account, downloading, installing, or using Manga Creator, you agree to be bound by these ToS. If you do not agree to all terms and conditions, do not use Manga Creator.

3. Eligibility

You must be at least 13 years of age to use Manga Creator. Users under 18 must have permission from a parent or legal guardian.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Providing false contact information of any kind may result in the termination of your account.

5. Use of the Service

Manga Creator allows you to generate images based on textual inputs and images you upload using AI technology. You agree to use Manga Creator only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of Manga Creator.

6. Content and Conduct

You are solely responsible for the text inputs and images you upload or use to generate images, and for any content you create, share, or display on or through Manga Creator. You must only upload photos and images that you own or have the right to use, and you must have the consent of any person depicted in them.
You must not use Manga Creator to create, share, or display:
  • Illegal or unlawful content.
  • Infringing content that violates intellectual property rights.
  • Content that is defamatory, obscene, pornographic, offensive, hateful, or promotes violence or harm.
  • Content that violates privacy or publicity rights.
Manga Creator reserves the right, but not the obligation, to review and remove or disable access to content that we determine, in our sole discretion, violates these ToS. Requests that are refused or removed by our moderation systems may still consume credits, as described in Section 10.
Zero Tolerance: Manga Creator has zero tolerance for objectionable content and abusive users. You can report objectionable content or abusive users to us at support@mangacreator.com. By using Manga Creator you agree to these terms and to this zero-tolerance policy.

7. Intellectual Property Rights

For any images/content you generate using our services, you retain full ownership to the maximum extent permitted by law. However, there are a few caveats:

  • Your ownership rights are limited by the terms of this Agreement.
  • The rights of any third parties may also affect your ownership.

8. DMCA Takedown Policy

Manga Creator respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to clear notices of alleged copyright infringement that comply with the DMCA.

If you believe that content available on or through Manga Creator infringes your copyright, you may submit a written notice to our designated Copyright Agent containing the following information:
  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material.
  • Your contact information, including your address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Notices of alleged copyright infringement should be sent to our designated Copyright Agent at support@mangacreator.com.

Upon receipt of a valid takedown notice, we will remove or disable access to the allegedly infringing material in a timely manner. If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent. We reserve the right to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

9. License Grant to Manga Creator

By using the Services, you grant to Manga Creator, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute text prompts/images you input into the services, or any output produced by the service at your direction, including without limitation images, videos, text, and other content. The license granted to Manga Creator remains in effect even after termination of this Agreement by any party, for any reason.

10. Pricing, Credits, and Subscriptions

Manga Creator offers paid credits, credit packs, and subscription plans that you may use to generate, continue, edit, enhance, or otherwise interact with manga and related content on the Service. All pricing, per-action credit costs (including for generation, continuation, edits, enhancements, and any future features), credit-pack contents, subscription benefits, and the number of manga you can produce per credit are subject to change at our sole discretion at any time, with or without prior notice, except where prior notice is required by applicable law.

Pricing and credit-cost changes apply going forward to new purchases, generations, and subscription renewal cycles, and will not change how many credits a past purchase or grant originally added to your balance. The credit cost of a given action is determined at the time the action is initiated, based on the then-current pricing displayed in the Service.

Credits have no cash value, are non-transferable, and are non-refundable except as required by applicable law. Subscriptions auto-renew at the then-current price and terms in effect at the time of renewal until cancelled. You may cancel a subscription at any time through your account settings or Stripe customer portal; cancellation takes effect at the end of the current billing period. We may also discontinue, modify, or limit any plan, credit pack, or promotional offer at any time.

Moderation and failed generations. Every generation request is screened by automated content-safety systems, both before and after the AI model runs. Credits are charged when a generation request is initiated, and the credit cost of a request is not refunded if the request is rejected, blocked, filtered, or removed because it violates these ToS, our content rules, or the usage policies of our AI providers. This includes prompts or reference images that are refused before generation, and generated output that is blocked or removed after generation. Because moderation costs us compute and provider fees whether or not an image is delivered, you accept that credits may be consumed with no output delivered in these cases. Repeated moderation failures may also result in account suspension or termination under Section 14. Whether a failed request is treated as a moderation failure is determined by us in our sole discretion, based on the reason reported by our systems and AI providers.

Credits included with a subscription plan are granted for the current billing cycle only and do not roll over to subsequent cycles; any unused subscription credits are forfeited at the end of each billing cycle. Credits purchased through one-time credit packs do not currently expire. We may change either policy at any time at our sole discretion. If we introduce or change an expiry, rollover, or forfeiture rule, the new rule may apply to credits already in your balance as well as to credits granted or purchased after the change.

11. Privacy Policy

Your use of Manga Creator is also governed by our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy.

12. Limitation of Liability

Manga Creator and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.

13. Changes to Terms

Manga Creator reserves the right to modify these ToS at any time. We will provide notice of any significant changes by posting the new ToS on the service.

14. Termination

Manga Creator may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these ToS.

15. Governing Law

These ToS shall be governed by the laws of the jurisdiction in which Manga Creator is based, without regard to its conflict of law provisions.
